1 Validity of the General Terms and Conditions

The company AP Care makes all deliveries exclusively on the basis of these general terms and conditions. By placing the order, the customer expressly agrees to the terms and conditions. These form an integral part of the contract between the customer and AP Care. They apply to the delivery of goods that the customer orders from AP Care on the website (www.apcare.ch).

2 Information on the website / offer / prices

The company AP Care always tries to inform the customers about the offered products and services in the best possible way.

All information on www.apcare.ch is without guarantee or liability. Within the legally permissible framework, AP Care excludes, in particular, any guarantee and liability for the correctness, completeness and topicality of the information on the homepage.

We reserve the right to make changes to prices and ranges at any time. Images of all products and illustrations may differ from the original. Technical designations may differ from the manufacturer’s designation or the information given on the Internet.

The current prices are published on the website at www.apcare.ch.

The prices are mutually binding at the time of the order. In the event of errors or mistakes in the price information, however, AP Care reserves the right to make price changes subsequently. Then the customer is informed and is not obliged to purchase the products affected by the price change.

3 Order / delivery

An order becomes binding for the customer when, at the end of the ordering process, he confirms his order on the page on which the complete overview of the order is displayed by clicking the button “Place order”. The customer then receives a confirmation email from AP Care to the email address given by the customer. Until this email is sent to the customer, AP Care reserves the right to change the

4 Delivery and delivery time

AP-Care has a wide range of products. The shipping policy stipulates that the company AP Care will, if possible, ship the products on the day of receipt of payment or confirmation of payment. The customer should therefore normally receive the products within 1 to 3 working days after receipt of payment. Ultimately, however, the delivery time depends on the post office and is outside the control area.

For certain items, the time of delivery may be further delayed depending on the manufacturer. AP Care can only be made liable for delays in delivery and their consequences if these were caused by a grossly negligent or willful breach of contract by AP Care. The company AP-Care assumes no liability for all other delivery delays and their consequences, including delays caused by the post office, AP Care suppliers or otherwise by third parties.

5 Products delivered in error

Articles delivered in error or too many articles must be returned immediately in the original packaging, at the latest after 7 days. Any items returned outside of this period will be billed.

6 Shipping costs

Shipping costs between a net order value of CHF 250 and CHF 500 are CHF 19.90. Shipping is free from a net order value of CHF 500.00.

7 Exclusion of warranty and liability

The company AP Care guarantees that the products are undamaged at the time of shipment. Products that were damaged when dispatched will be repaired or replaced at the option of AP Carel, provided that the customer informs AP Care of the defect within 8 days of receipt of the goods by email. If AP-Care so wishes, the customer must also immediately return the delivered products in the original packaging to AP Care. Furthermore, AP-Care is liable to the customer for damage if and to the extent that such liability on the part of AP-Care arises from the Product Liability Act.

Any further guarantee for the products supplied and any liability for damage caused by these products is excluded, unless AP Care has fraudulently concealed the product defects in question. However, if AP Care can assert further warranty claims against its suppliers for the product in question, AP Care will, as far as possible, assign these claims to the purchaser at the request of the purchaser. However, AP Care assumes no responsibility for ensuring that these claims can be successfully enforced. The same applies to any claims that AP-Care has against Swiss Post for damage that occurred during transport. In particular, AP Care does not guarantee that the products are suitable for the use planned by the customer or that they produce a specific result. The warranty also excludes damage for which the buyer is responsible, e.g. as a result of improper handling, or damage caused by external influences for which the seller is not responsible, such as damage that occurred during transport.

8 returns

If you want to return the goods, the packaging must be unopened. The buyer bears the return costs. Please register the return beforehand by e-mail to info@apcare.ch or by phone +41 58 510 87 06.

9 Means of payment and invoicing / dunning

Orders via the AP Care website must be paid in advance using the means of payment specified on the AP Care website. After the 1st order, payment can also be made by invoice.

10 data protection

The data necessary for the business transaction are stored and processed for the purposes necessary for this purpose and, if necessary, forwarded to affiliated companies or contractors (such as the post office or companies to check the creditworthiness. All personal data will be treated confidentially.

11 liability

Liability for product defects or damage caused by such defects is based exclusively on Section 7. For damage from late delivery, Section 4 is exclusively relevant.

Apart from that, AP Care excludes any other liability to the customer for damage caused in connection with the products, the use or the (non) availability of the www.apcare.ch website within the scope of what is legally permissible. For example Claims for damages due to impossibility of performance, non-fulfillment and tortious acts against AP Care are excluded.

12 Partial invalidity / validity-retaining reduction

If a provision of these terms and conditions should be wholly or partially invalid, this does not affect the remaining provisions.

13 Changes to General Terms and Conditions

AP Care expressly reserves the right to adapt these general terms and conditions at any time.
